This Privacy Policy explains how Bobardt Enterprises Inc. processes Personal Data in connection with the Xelthron Business Network (XBN) platform. It applies to the XBN website and the platform features that are currently available.

2. Scope

This Policy applies to the XBN website and the XBN features, including personal user profiles, company profiles and public company pages, networking/connectivity features, internal messaging, email and calendar integrations (to the extent enabled by you), meeting features (Xelthron Meet), marketplace, products/services, jobs/applications, projects, and payments/billing through the integrated payment infrastructure.

Depending on the feature, other roles (for example responsibility of an Organization for its own content or offers) may apply. This Policy describes processing by XBN in the context of using the platform.

3. Categories of Personal Data

The data processed may include registration and account data (such as name and email), profile and company information, content you publish or share (such as messages, posts, comments, documents/data-room contents where available, application/project information, reviews and ratings), communication and transaction data related to the platform, usage and log data (such as IP address, time, requested resource, device and browser information), and cookie or similar technologies.

When integrations are enabled, additional function-specific data may be required to provide the integration (for example metadata for email/calendar features). For payments, payment providers handle payment data; XBN processes the necessary billing and payment-related information.

4. Sources of Personal Data

We process Personal Data that you provide (for example during registration, profile updates, messaging, content publication and integration enablement) as well as data generated by your use of the platform (for example usage and log data).

Depending on the feature, data may also originate from third-party providers you connect or enable (for example email/calendar providers, LiveKit/meeting infrastructure, payment providers) or from publicly accessible sources where the platform features support it.

5. Purposes of Processing

We process Personal Data to provide the platform, enable accounts and profiles, support your communication and networking features, display and moderate content, provide integrations (to the extent enabled), and handle payments and billing, as well as to ensure security, fraud prevention, troubleshooting and system stability.

Other purposes may include complying with legal obligations, pursuing legitimate interests (for example abuse prevention, evidence and legal defense), and improving the platform through statistical/analytics.

6. GDPR Legal Bases

Processing is based on different legal grounds depending on the purpose: Article 6(1)(b) GDPR (contract/contract performance) for providing accounts, platform features and delivering paid services; Article 6(1)(c) GDPR (legal obligation) for purposes required by law; Article 6(1)(f) GDPR (legitimate interests) in particular for security, fraud prevention, system stability, abuse prevention, quality and improvement analytics, and for establishing, exercising or defending legal claims.

Where consent is required (for example for non-essential terminal access via cookies or consent settings), processing is based on Article 6(1)(a) GDPR. You may withdraw consent with effect for the future.

7. Accounts and Personal Profiles

When you create an account, we process account data and the profile information you maintain in order to enable platform functionality, provide you with features, and support your preferences.

You may use visibility settings for certain profile information. Please note that published content may be publicly accessible depending on your settings and the relevant feature.

8. Company Profiles and Public Company Pages

Organizations and companies may create company profiles and publish content. Depending on the visibility settings, these contents can be publicly accessible and may be indexed by search engines.

XBN provides the technical platform for publishing and discovery. Users/Organizations are responsible for the lawfulness of the content they publish.

9. Public Content and Search Engine Visibility

To the extent you or an organization explicitly make content public (for example company profiles, startup and investment information, marketplace listings, job postings, projects and other clearly published content), these items may be publicly accessible through XBN and indexed by search engines.

Even if content is changed or removed on XBN, search engines or external services may temporarily store copies, caches or index entries. XBN has no control over such external storage.

10. Startup & Investment Hub

Startups and companies may publish information such as business model details, funding needs, investment requests, pitch information, pitch materials, videos, documents, points of contact and project-related details.

The platform enables presentation, discovery and contact. XBN does not provide financial or investment advice and does not guarantee funding outcomes.

11. Projects and Project Participation

Depending on how you use the platform, project information and participation details may be created, displayed and, if made public, discoverable. We process the data required to enable permissions, display and interactions.

Your role and visibility settings determine which project information is shown to authorized users and/or the public.

12. Jobs and Applications

Employers and organizations may publish job postings and professional opportunities. Applicants may provide application data and relevant information to the extent necessary for the application.

XBN is not an employment agency. Users and organizations remain responsible for their statements, offers and communications.

13. Marketplace

On the marketplace, users/organizations may offer products and services. We process the data required to enable display, search, contact and the technical handling of the relevant features.

As a rule, the contracting parties for offers and services are the involved users/organizations. XBN does not guarantee specific market listings.

14. Messages and Communications

If you use XBN internal messaging, we process message content and function-specific metadata to provide delivery, display and (where applicable) moderation.

Please note that third parties may only obtain messages outside XBN if you intentionally share or export content.

15. Email Integration

XBN allows connecting supported email features with compatible providers to the extent you enable the integration. We process only the data required to provide the integration you have enabled.

Credentials and tokens are not unnecessarily publicly displayed or made accessible to other users. You can disconnect integrations at any time.

16. Calendar Integration

XBN may connect calendar functionality with compatible providers or provide calendar features inside the platform. We process event, participant and integration data only in accordance with the feature you enable.

When you disconnect an integration, processing that is no longer needed for ongoing functionality is stopped where technically possible.

17. Xelthron Meet

Xelthron Meet enables audio/video communication and meeting features within XBN. To run this feature, we process the necessary technical connection, participant and communication data required to operate the meeting functionality.

By default, XBN does not assume that meetings are automatically recorded. Recording features are introduced only with clear prior information and the required consent/notification mechanisms.

18. Payments and Billing

When you purchase a paid feature, payment is handled through the integrated payment infrastructure (checkout is Stripe-based as of the current product status). We process the required order, status and transaction information to enable payment, accounting and fraud prevention.

Payment details are processed by payment providers according to their terms. XBN processes only the information necessary for billing and operating the payment feature.

19. Cookies and Similar Technologies

We use cookies and similar technologies to provide core functionality, store preferences and (where required by law) obtain consent for optional purposes.

For details about categories, purposes, durations and objection mechanisms, see the Cookie Policy under `/cookies` and the Privacy Options under `/privacy-options`.

20. Analytics and Platform Improvement

Depending on consent and applicable jurisdiction, we may process analytics data to understand reach, errors, performance and usage trends and to improve the platform. Such analytics also support security and stability.

Where analytics concerns optional purposes, it is performed according to applicable requirements (for example only after consent for consent-required cookies).

21. Security and Fraud Prevention

XBN uses appropriate technical and organizational measures to protect Personal Data, taking into account risk, purpose and scope of processing. This includes access controls, secure transmission, logging and measures to prevent abuse and fraud.

Personal Data breaches are assessed under applicable legal requirements. Affected individuals and competent authorities are notified when statutory thresholds are met.

22. Recipients and Service Providers

Recipients may include hosting and infrastructure providers, support and maintenance partners, analytics/operations providers, payment providers, email/calendar integration providers (where enabled), and LiveKit meeting/infrastructure providers.

For platform features, content may also be made visible to other users. Information that you intentionally share may therefore be accessible to authorized recipients.

23. International Data Transfers

Bobardt Enterprises Inc. is based in the United States. Therefore, where necessary to provide the service, Personal Data may be processed in the United States and other countries where service providers operate.

For transfers from the EEA/UK/Switzerland, we use appropriate safeguards where applicable (for example Standard Contractual Clauses and additional measures when required).

24. Retention and Deletion

Personal Data is retained only for as long as necessary for the relevant purposes, while an account or corresponding feature is in use, or where legal retention, security, dispute resolution or evidence obligations require longer retention.

After the purpose is fulfilled, data is deleted or anonymized unless a legal obligation or another permitted basis allows continued storage. For payment, invoicing and tax-related data, applicable statutory retention requirements apply.

25. GDPR / UK GDPR Rights

Where applicable, you have rights of access, rectification, erasure, restriction, data portability and objection. If processing is based on consent, you may withdraw consent with effect for the future.

You can also file a complaint with a competent supervisory authority. Where automated decisions with legal or similarly significant effects are applied, the relevant safeguards apply.

26. United States Privacy Rights (where applicable)

Depending on applicable law, residents of certain U.S. states may have rights including access/know, correction, deletion, portability and opt-out of sale/sharing or targeted advertising where legally applicable. Rights to limit certain Sensitive Personal Information and non-discrimination may also apply.

27. California Notice at Collection

When visiting XBN and using its features, we may process categories such as identifiers and contact information, profile/company information, content and communications data, usage and log data, and where applicable payment-status data. Purposes include account provision, platform operations, communication, security, support and billing, as well as legal compliance.

The exact data processed depends on the features you use and the integrations you enable.

28. Sale / Sharing / Targeted Advertising

XBN does not sell Personal Data for money. To the extent XBN processes data for marketing and analytics purposes (for example through optional cookies or related settings), it does so in compliance with applicable requirements, including where consent is required and with available opt-out/withdrawal controls.

You can manage these preferences through cookie settings and the Privacy Options.

29. Sensitive Personal Data

XBN generally does not request Sensitive Personal Data. If you nevertheless provide or publish such data voluntarily, we process it only to the extent necessary in connection with the feature you request and where a valid legal basis applies.

Please note: depending on the context, publishing sensitive data may have significant consequences for you.

30. Children and Age Requirements

XBN is intended exclusively for persons aged 18 or older. Registrations by minors are not permitted. We do not knowingly collect data from children under 13.

31. Automated Systems / AI

XBN may support recommendation and search/ranking features using usage and profile information. These features aim to improve discoverability and user experience and may involve automated processing.

Where XBN uses AI features, applicable transparency requirements under the EU AI Act are considered. Article 50 transparency obligations apply since 2 August 2026, where relevant AI systems are involved. When you interact directly with a relevant AI system (for example in enabled AI-assisted features), we will clearly inform you that you are interacting with AI. The currently in-development live translation capability is not described as already production-ready.

32. Changes to the Privacy Policy

We may update this Privacy Policy, for example when features change, when laws change, or when we improve our processes. Material changes will be communicated in a way that allows you to understand them.

Updates do not retroactively restrict your existing statutory rights.
